Terms of Service and Food Allergy Notice

These Terms of Service govern purchases and services provided by Burns in the Kitchen (“Burns in the Kitchen,” “we,” “us,” or “our”). By placing an order, enrolling in the Custom Meal Service, or using our services, you agree to these terms.

Our Custom Meal Service

Our Custom Meal Service is built around each customer’s preferences, goals, dietary needs, household, and serving requirements. Customers receive access to a dedicated Foodie Concierge who assists with weekly meal planning and service-related requests.

Customers may send recipes or request meal changes and additions during the week. Menu preferences, recipes, and similar requests must be submitted by Friday at noon for the applicable production schedule.

Although we make reasonable efforts to accommodate requests, ingredient availability, food safety, production capacity, seasonal availability, cost, and dietary compatibility may affect what we can provide.

Customer Information and Dietary Requests

Customers are responsible for providing complete and accurate information about:

  • Food allergies and sensitivities
  • Dietary restrictions
  • Ingredient exclusions
  • Food preferences and dislikes
  • Household and serving needs
  • Relevant delivery or pickup instructions

All essential dietary restrictions and preferences must be included in the customer’s official questionnaire, account, or written service record. A telephone conversation, text message, or informal request does not replace the information maintained in the customer’s official profile unless Burns in the Kitchen confirms the update in writing.

Customers must promptly notify their Foodie Concierge when their dietary needs, allergies, medications, health conditions, delivery information, or household requirements change.

Shared-Kitchen and Allergen Notice

Burns in the Kitchen recipes are made without gluten, dairy, soy, peanuts, or refined sugar, and we do not cook with seed oils.

Meals are prepared in a shared commercial kitchen that is not a dedicated gluten-, dairy-, soy-, peanut-, or allergen-free facility. The facility may store, prepare, or handle major allergens and other ingredients that Burns in the Kitchen does not use.

Burns in the Kitchen uses its own equipment, cookware, utensils, storage items, and supplies wherever possible. However, certain shared commercial appliances—including the flat top, ovens, and stovetops—may be used. The facility is professionally cleaned, and Burns in the Kitchen follows cleaning, separation, and food-handling practices intended to reduce cross-contact. Nevertheless, the complete absence of allergen cross-contact cannot be guaranteed.

Customers with severe or life-threatening food allergies should contact Burns in the Kitchen before ordering and consult a qualified medical professional about whether food prepared in a shared commercial kitchen is appropriate for them.

Medical and Nutritional Disclaimer

Burns in the Kitchen provides food services and general nutrition-focused support. We are not a medical provider, hospital, pharmacy, or emergency service.

Information provided through our website, staff, menus, or communications is not medical advice and is not intended to diagnose, treat, cure, or prevent any illness. Customers should consult their physician, registered dietitian, or other qualified healthcare professional regarding medical conditions, allergies, medications, and individualized nutrition needs.

Never disregard professional medical advice or delay seeking care because of information received from Burns in the Kitchen.

Weekly Renewal

The Custom Meal Service automatically renews each Thursday using the customer’s payment method on file.

Each Wednesday, customers will receive a link allowing them to skip an upcoming week or request an adjustment to their serving size. Customers are responsible for submitting the requested change through the provided method and confirming that it was received.

Order changes must be submitted no later than 6:00 p.m. Central Time on Thursday. Requests received after the deadline may apply to a future service week and cannot be guaranteed for an order already renewed or placed into production.

Cancellation

Customers may discontinue the Custom Meal Service by notifying their Foodie Concierge or emailing info@burnsinthekitchen.org.

Cancellation applies prospectively. If a renewal payment has already been processed or an order has entered planning, purchasing, preparation, or production, that order remains subject to the non-refundable policy below.

Non-Refundable Custom Orders

All custom meal orders are non-refundable.

Our meals are personalized, perishable products planned and purchased around the customer’s stated needs. Once an order has renewed or been submitted, Burns in the Kitchen commits time, ingredients, labor, kitchen capacity, and delivery resources specifically to that customer.

A refund or credit will not be issued because:

  • A customer or family member dislikes or does not enjoy a meal
  • A preference, dislike, allergy, or restriction was not included in the official customer profile
  • A customer changes their mind after renewal or ordering
  • A customer fails to skip, modify, or cancel before the applicable deadline
  • A customer is unavailable to receive an arranged delivery or pickup
  • A customer does not consume the meals within the recommended period

Errors by Burns in the Kitchen

A service credit may be provided when Burns in the Kitchen confirms that it made an error with an order.

Customers should report suspected order errors promptly and provide the order information, description, and photographs when applicable. Credits are limited to the portion of the order affected by the confirmed error. Unless required by law, credits are not provided for personal taste preferences or information that was missing from the customer’s official profile.

Delivery, Pickup, Shipping, and Food Storage

Customers are responsible for providing accurate delivery and contact information and for making reasonable arrangements to receive or retrieve their meals.

Perishable meals should be refrigerated or frozen promptly after receipt and handled according to the instructions provided with the order. Burns in the Kitchen is not responsible for deterioration caused by delayed retrieval, improper storage, unattended food, incorrect reheating, or handling after delivery or pickup.

Delivery and shipping schedules may be affected by weather, road conditions, carrier delays, facility interruptions, emergencies, or other circumstances beyond our reasonable control.

Third-Party Services

Ordering, payments, subscriptions, messaging, reviews, newsletters, and other features may be provided through third-party platforms such as Bottle, SoTellUs, Beehiiv, payment processors, delivery providers, and shipping carriers.

Use of those services may also be governed by the provider’s terms and privacy policy. Burns in the Kitchen is not responsible for third-party outages, platform changes, or practices outside our control.

Intellectual Property

The Burns in the Kitchen name, logo, website content, original recipes, photographs, written materials, service descriptions, and branding may not be copied, reproduced, distributed, or used commercially without written permission.

Customer-submitted recipes remain the customer’s property. Submission of a recipe gives Burns in the Kitchen permission to use and adapt it for the purpose of preparing the customer’s meals.

Limitation of Liability

To the fullest extent permitted by law, Burns in the Kitchen is not responsible for indirect, incidental, special, or consequential damages arising from the use of our website, third-party platforms, or services.

Nothing in these terms excludes rights or responsibilities that cannot legally be excluded.

Changes to These Terms

We may update these Terms of Service as our offerings, schedules, policies, or legal obligations change. Updated terms will be posted on this page with a revised effective date. Continued use of the service after an update constitutes acceptance of the revised terms.

Governing Law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
